Copyright & DMCA Policy

1. Our policy

Kasiel respects the intellectual-property rights of others and expects users to do the same. We respond to clear notices of alleged copyright infringement that comply with the U.S. Digital Millennium Copyright Act of 1998 (the “DMCA”) and, where applicable, with corresponding notice-and-action procedures under EU and UK law (including Articles 14–17 of the EU Digital Services Act, Regulation 2022/2065).

We will, in appropriate circumstances and at our discretion, terminate the accounts of users who are repeat infringers.

2. Submitting a notice of alleged infringement

If you believe that material accessible on or through the Service infringes your copyright, please send a written notice to our designated agent (below) including all of the following:

  1. An electronic or physical signature of the copyright owner or a person authorised to act on their behalf.
  2. A clear identification of the copyrighted work claimed to have been infringed (or, if multiple works, a representative list).
  3. A clear identification of the material claimed to be infringing, with information sufficient to permit us to locate it (URLs are best).
  4. Your full name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the disputed use is not authorised by the copyright owner, its agent or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or are authorised to act on the owner's behalf.

Knowingly making a material misrepresentation in a DMCA notice may make you liable for damages under 17 U.S.C. § 512(f).

3. Counter-notice

If you believe that material you posted was removed or disabled by mistake or misidentification, you may submit a counter-notice including:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification.
  4. Your full name, address and telephone number, and a statement that you consent to the jurisdiction of the U.S. Federal District Court for the judicial district in which your address is located (or, if your address is outside the U.S., to a judicial district in which Kasiel may be found), and that you will accept service of process from the person who submitted the original notice or that person's agent.

Upon receipt of a valid counter-notice we may, at our discretion and consistent with the DMCA, restore the removed material unless the original complainant files an action seeking a court order against the alleged infringer within 10–14 business days.

We may share the contents of any notice (including the complainant's identity) with the user who posted the allegedly infringing content.

5. Trademark and other IP complaints

If you believe content available on or through the Service infringes a trademark, database right, design right or other intellectual-property right, please email legal@kasiel.com with details substantially equivalent to those required for a DMCA notice. We will review and respond as appropriate.
